Default Quick change oil stations

Had anyone had any experience where one of these places did not put enough oil in your car and damaged the engine? What did you do to get it resolved? I had just had the motor rebuilt in my 07 tc.

After 1k miles I was changing to synthetic. They only put 3 1/2quarts of oil in when I paid for a full change and filter. They denied my claim staying I needed to do a tear down because there is nothing to prove a lack of oil caused the failure. I had only driven it 88 miles after the change. I know I can win a lawsuit in small claims court but I have to word the suit properly. Any suggestions?

To be honest, 3.5 quarts is not terribly low that it should fail in less than 100 miles. That's only 0.6 quarts from being full, and should be sufficient to fill the sump and have full oil pressure. How do you know that 3.5 quarts were present when it failed? Sure it wasn't less than that, or maybe was left completely empty?

Thats well enough oil to run the car.
If the motor lock up and fail. Then oil drain to find 3 plus qt.
That would be an oil pump failure and not lack of oil.
