Better yet, go grab a bunch of rice buddies to make a video tape that you can use in court. Have them all rushing past you doing 85+ and then show the judge that so he can see that everyone is crazy on that highway. Get one of your buds to moon you with his ___ out the moonroof while he's doing 90 on the freeway. Guaranteed to get you cleared of that ticket. "You see, your honor. People are nuts on this freeway. I was trying to get home as quickly as possible!!!"

Yeah, that's a good idea. Even Microsoft tried something like that (see http://www.chguy.net/news/feb99/demoMS.html ). They still got convicted.

EDIT: fixed URL

The camcorder bit I told you about. Film yourself (you know, with a friend holding the camcorder) doing the limit or maybe 5 over. Hope to GOD that on that day everyone is blazing past you. Keep cutting back to your speedometer so you can show you're going the appropriate speed and not like 12 in a 55 or anything. Then mention that you're upset because the freeway's average speed is so high you were fearing a collision if you maintained the speed limit or were afraid of getting a ticket for being a hazard (too slow... THAT IS a law as well...)

Might not work, but worth a shot. Also mention that you've never been pulled over before. It's a lot better than someone that's had a few other speeding tickets and tries to get out of it.

More importantly though...

DID YOU LEARN ANYTHING FROM THIS?

How is your driving record? If this is your first ticket it should be reduced.

Bro i am from CT and i got pulled one time for doing 68 in a 40... oops. Now in CT i know that many courts on your first offense are will to either drop it or significantly reduce it. Given the time of day and the traffic conditions, and that the L.I.E SUCKS (sorry dude but it does lol).. i think you have a good shot of fighting it. You should always fight cops and the law when it comes to speeding infractions, there are so many variables to take into consideration. Fight it and let me know how it goes!

If I do record the highway... What speed should I be doing? And should I show that speed on the camera? I'm guessing 55 and yes show it right?

From my experience (I'll refrain from listing it here), your only chance for getting out of a ticket is if you find something wrong with how you were clocked/timed/ticketed (pretty much what wholeflaffer said), or you go to court and the office doesn’t show. What was the method used anyway?

Ok, take it from a cop and and ex NYer...at this point the only thing you can do is plead not guilty and when you go for your first court appearance ask the Asst. DA (if he doesnt offer first) if he would agree to reducing it to an "1110 a" (failure to obey taffic control device). It will not be as many points, it wont count against your insurance, but you will pay the same fine. Trust me...this is the best you can hope for. The mistakes on the ticket mean nothing as the offcier is allowed to ammend the ticket at any time or while you are standing in the court dismiss that one and write another. You could pay a laywer (a lot more then $400) but you wont get it dismissed entirerly and probably wont any better a deal then I just quoted.

1 constant shot... NO CUTTING... and as you're showing cars blazing past you, go back to your speed to show YOU are maintaining and EVERYONE else is crazy. Re-read my last post dude... it's all there

Just drive the speed limit (55, 65, whatever it is posted at). Might be helpful to videotape at roughly the time of day of your violation, along the same stretch of road, and on the same day of the week as indicated on your ticket. The closer you are to an accurate reenactment of your alleged violation, the more the judge might take the circumstances into account. Hopefully the weather will cooperate.

Be as professional as possible on tape. No laughing, unnecessary comments, etc. If possible, have a GPS with time/date and speed display to show on camera from time to time. Dress well in court (business casual is OK) and on tape (if you appear there) and be sure that the court is prepared ahead of time for your videotape to be shown.

Not that any of this will be likely to provide convincing evidence to the judge, especially if you are pleading innocent . You will not have shown the judge any reason to think you were NOT speeding. You'd perhaps be pleading "guilty with extenuating circumstances", which is what the videotape might help you with. A convincing plea of guilt with extenuating circumstances generally results in a reduction of fine or points, but rarely complete exoneration. To get off scot-free you'll generally have to prove convincingly that you were not properly cited for speeding...or just hope the cop doesn't appear in court.

Don't know about anywhere else but in VA 80 or 20 mph over the speed limit is automatic reckless. Goes on your record 10 years no if, ands, or buts. They might reduce it if it is your first offense.

We have by far the gayest traffic laws of any state.

I had a speeding ticket dropped because the cop didn't show up in court. However, DMV STILL made me go to traffic school....

Here's to hoping the cop doesn't go to court... Here in NY the court is so backed up... My friend was ticketed in November, and his court date is in August... I guess when I plead not guilt, my date will be around December lol. Think if I postpone the date once or twice, my chances of the cop not showing will increase?

I don't know how the courts up there deal with postponements, but if they're willing to grant one they'll probably require a bond paid up front, for the value of the fine and fees. Of course, they'll give it back to you when you win .
