§ 46.2-1049. Exhaust system in good working order.

No person shall drive and no owner of a vehicle shall permit or allow the operation of any such vehicle on a highway unless it is equipped with an exhaust system in good working order and in constant operation to prevent excessive or unusual levels of noise; provided however, that for motor vehicles, such exhaust system shall be of a type installed as standard factory equipment, or comparable to that designed for use on the particular vehicle as standard factory equipment. An exhaust system shall not be deemed to prevent excessive or unusual noise if it permits the escape of noise in excess of that permitted by the standard factory equipment exhaust system of private passenger motor vehicles or trucks of standard make.

The term "exhaust system," as used in this section, means all the parts of a vehicle through which the exhaust passes after leaving the engine block, including mufflers and other sound dissipative devices.

Chambered pipes are not an effective muffling device to prevent excessive or unusual noise, and any vehicle equipped with chambered pipes shall be deemed in violation of this section.

(Code 1950, § 46-305; 1952, c. 455; 1956, c. 651; 1958, c. 541, § 46.1-301; 1960, c. 120; 1970, c. 266; 1972, c. 66; 1989, c. 727; 2006, cc. 529, 538.)

info from http://law.justia.com/virginia/codes...46.2-1049.html

I haven't been pulled over for exhaust or tint yet (other than tinted tail lights). I have the Ptuning 3" header-back exhaust and 35% tint all around. I also drive from Stafford, VA to Springfield, VA every day.

Luckily Stafford doesn't seem too concerned about car mods as long as the driver isn't driving stupid. Fairfax on the other hand will pull anyone over for anything, especially if it has any indication of modifications (wheels, aftermarket tail lights or headlights, etc).

I noticed that the regulation states that "No person shall drive and no owner of a vehicle shall permit or allow the operation of any such vehicle on a highway..". I know Interstate 95 and US Route 1 are considered highways, but what about rural roads? Can you fight if you receive a ticket on a secondary road?

None in our eyes, but it's state by state rules just cuz they CAN. It sucks, I know it. But as far as exhausts in California. California's the death trap for tuners because of emissions laws. When cops see exhausts, they think emissions & thats why we get tickets. That's why there aren't any CARB legal turbos. Getting something CARB legal costs a good chunk of money that the majority of companies don't have & it's a long process which is why when aftermarket (YES, TRD IS AFTERMARKET) everything states "For offroad use only" - essentially, you can't drive with it on the streets. Now where's the logic behind that? I don't know. What's the difference of driving a car with an exhaust on the road vs. a track? Noise pollution? C'mon.

Anyway, in the end, busting people like you is how the cops get paid (not through quotas or commissions like you may be thinking I meant) but even paying the measley fine, that's how the state gets money & pays the cops.

Do you like my attitude better now?

lol see we can all be friends, but yea i just dont see how companies (dealerships expecially) can sell things knowing that they are not legal, like if you were buying a tc and it had the trd muffler on it, how the heck is the buyer supposed to know it illegal the delership wont inform you they are all about selling that car to you

kisskiss you can be a brat whenever. I am in the same boat as you are on this. The officer did have reasonable cause to pull you over, unlike another poster said. Your tinted license plate cover is enough to pull you over and give a citation. By the time he got behind you he probably then noticed the exhaust was unchambered and added another citation on top of that.

I have been pulled over a few times for no front plate. And yes even in the windshield under WA state laws is illegal because it isnt properly mounting on the front bumper (silly little legalities). My view is, if they plan on pulling me over they will pull me over after being behind me, where my plate is located. I have had two tickets and I dont ever plan on fixing them, and any future car the first thing I plan on doing is taking the front plate off.

She didn't blow it out of proportions, she stated a fact that you were whining for breaking the law. There are reason why they are in place, we can think they are a joke or not, but when it comes down to it its the law.

p.s. a tinted plate cover hides plates from side angles, meaning that the cop can not see your plate number from a certain angle. also when they get dirty, they hide the number much much better with just a little bit of dirt than without because of the tint. its logical.

TRD exhaust is legal in wa state. the reason why they put that on packaging is to save toyota's butt across the board. Look at fog lights next time you walk into autozone. yup fog lights are for off road use only. think of it, they create an exhaust that is under the decibel level, but unchambered or vise versa. You get a ticket and they didnt have that stipulation on their product. they could be sued for selling a product that is illegal in your state only. i.e. radar detectors in VA is a great example. perfectly legal elsewhere except va.

even though they are law, they seem a little redicoulous, virginia need to have a dB note law, cuz right now it anything other than stock is illegal
Well then that's their law. Whatever their reason, it's the law. If it really bothers you that much, move. But don't pass your mistakes off on cops doing their jobs.

My car is modified, and jersey has exhaust laws, but I dont do anything to make them pull me over. Front tint is illegal in Jersey, so I dont have it.

Then you gotta conform to their laws. As for the jersey exhaust law, it's basically at their discretion. It's secondary so they cant pull you over for the exhaust, but if they do pull you over they can give you an exhaust ticket.

when you let off the gas, especially at highway speeds with the rpm's around 3, the exhaust is extremely loud, louder than when you would have it on the gas keeping a speed. and tinted liscence plate covers are just asking you to get pulled over, cop did nothing worng
