Default xB 2 days old, hit - Need New Bumper Already!

Unbelievable. I get my new Blue Onyx Pearl xB on Tuesday evening and Thursday night, while stopped in traffic due to icy conditions on an expressway, an idiot in a mid-1990s Jeep Cherokee flys into the concrete median, bounces off it and smashes into the driver's side front corner of my xB and then hits a Ford F-150 in front of me with such force that he knocks the tailgate door off the pickup and does not come to a stop until he has slid up the road about 400 yards. At that point he merged with traffic and drove off.

The point of impact was in front of my front wheel and the damage appears to be cosmetic, and limited to the front bumper. The fog light popped out, but still works and appears to be in acceptable condition. The stearing is still alligned and there do not appear to be any scratches on my beautiful 17 inch MR-7 (hyper black) front wheel.

Still, its anoying when people can't keep a proper lookout, yeild to avoid an accident, or have the common decency to stop and admit the damage their stupidity caused. At least no one was hurt... still I'm not to happy someone else's stupidity is going to cost me my $500 deductible and a rental car. (Especially since I got the Scion to be my practical car while my 2005 Z51 Corvette sits in the garage due to snow or because I need to transport my two young children... On that note, I think the Scion might be better engineered and assembled than my new Corvette... but that is likely a topic for another post... )

If someone happens to have a blue onyx front bumper I'd love to buy it. (I really just needed to post to vent - but if I happened to find a lonely bumper it would make my day.)

I take the xB to Progressive's Concierge Service this morning to hand it over unless I find the needed part to fix it myself first...

I'm a long time lurker on this board and never imagined my first post would be to vent about getting creamed...

My scionlife.com t-shirt and license plate frame will likely arrive while I'm driving some stupid rental car and my xB is under the knife. What a bummer....

Hi, I understand your pain...I got a rock scratch on my hood the first week of ownership. Probably you saw my topic here crying and complaining...it happens, the moment you take the car out of the dealership....anyway, I happy again with pin stripes on the hood that covered completely the damage. Your car will be like new soon.

Nice to see another Indianapolis xB owner on here!

I looked into the OEM bumper cover (Right Fender, Left Fender and bumper support) and it looks like the parts will exceed my deductible... Unless I can convince Progressive that a hit and run is actually a UIM (uninsured motorist) claim with no deductible...

Anyway, what color is your box? I'll look for it and waive when I see you. (I live in the slums of Giest and work just off the circle downtown, so I'm all over town...) Also, I can't help but waive to xBs - even when I'm driving my vette - so if a silver vette waives at you... you know why...

Hi guys, proud owner of a xB TCM....I just think this color is the best, specially at night. Anyway, I had to buy a car to go to work, about 33 miles each way driving and the xB was the winner. Wife has a Matrix AWD and really likes it.

I live in Greenwood. Bought my xB during the Thanksgiving weekend. By the way, I would like to suggest two things: 1 - You need to put a pollen filter behind the glovebox, it's really easy and helps dust inside the car. 2 - The front strut tie bar, it's a optional that cost $175.00 and it's worth it. Let's keep talking.
I'm really interested in being part of a scion owners car club in Indiana.

Unless people have bought a new bumper kit it might be hard to find a new used bumper try www.bbist.com , OR http://www.jfracing.com/shopdisplayp...=X%2FB+04%2D05 Im' sure if you use a Google search you may come up with something else also chech some Salvage Yards in your Area Good Luck .

Wow! did you get pictures? 400 yards would be a new record for skid marks on a public road, since the old record is 316 yards.

Bummer about your car, though. Hope you find someone installing a body kit who can supply the parts you need.

At least it wasn't your Vette that got hit. They should waive your deductable though.

Default Repairs Estimated...

The Box should be back by the middle of the week. Progressive is using a poly bumper... isn't the OEM bumper fiberglass? Also, the repair estimate has no mention of the front spoilier... although it lists each light (all operational) and says Remove/install. Makes me think they do not realize that there are two pieces to the bumper. (I have left them a voice mail asking if they are using the original or if they did not realize there were two parts...

Essentially, they have the repair as a new front bumper cover, new fender liner, a refinish of my left front 17 inch MR-7 (three small chips in the hyper black finish) and a refinish the left front quarter pannel (that has about 1/2 inch of scratches on the very edge...)

I think a poly bumper cover is allright - isn't poly typiically more durible than fiberglass?

Progressive fed me some BS about Indiana law requiring that the vehicle in a hit and run be identified before uninsured or underinsured coverage applies. Needless to say they assumed that I would take their word for it (not log into westlaw and look up the Indiana UIM and UM statutes.) My first few weeks as an attorney I actually had to review the UIM/UM statutes in all 50 states... Of course what the Progressive rep was selling was a load of BS, so I sent them the following letter:

Dear Rob,
A quick review of Indiana's statutes did not turn up any support for your contention relayed to me over the phone this morning that Indiana requires the positive identification of the hit and run driver before UIM or UM coverage applies. That is simply not part of the statutes in Indiana. In fact, the case law seems to clearly state that UIM/UM is avaiable in a hit and run with direct physical contact (quote and citation below):

In cases involving hit-and-run automobiles, this Court has determined that the occurrence of some type of 'physical contact' between the hit-and-run automobile, and the insured automobile is a condition precedent to recovery under a policy's uninsured motorist clause. Blankenbaker v. Great Central Ins. Co. (1972), 151 Ind.App. 693, 28 N.E.2d 496; Ely v. State Farm Mutual Automobile Ins. Co. (1971), 148 Ind.App. 586, 268 N.E.2d 316.

Allied Fidelity Ins. Co. v. Lamb 361 N.E.2d 174, *177 (Ind.App. 1977)

Rob, if Progressive continues to treat this claim as collision and not a UIM/UM hit and run, please immediately send me a full copy of all my policy provisions and a copy of all statutes and case law that supports Progressive's position that UIM/UM coverage requires the positive identification of the vehicle that hit and then ran.

As I see it, Indiana requires UIM & UM and it is bad faith to limit UIM & UM in a way not intended by the legislature (which includes statements about provisions of Indiana statutes which are not and have never been there).

In addition to the full policy and any statutes or case law you send, should Progressive insist on taking the current position, please send me a full transcript of the December 16, 2005 conversation in which you informed me that UIM/UM did not apply.

A small amount of snow caused a large amount of trouble Thursday night.
The brief snowstorm blew across the Indianapolis area around 7:30 p.m., even briefly flashing lightning across the skies during the 15 to 20 minutes it lasted.
"It was a pretty narrow band and pretty quick," said National Weather Service forecaster Ed Terrell.
It left only 0.2 of an inch of snow on the ground, but it was a perfect storm for disrupting traffic.
Even before the snow came, decreasing temperatures were causing formation of "black ice" on pavement, and the midevening snowfall joined that ice to make an exceptionally slippery driving surface.
The result was numerous motorists sliding out of control into ditches, against guardrails and into one another. An accident at I-70 and I-465 on the Eastside brought traffic on I-70 to a halt.
Some streets were covered with ice, requiring officials to shut them down until salt trucks could arrive.
The Department of Public Works was caught by surprise. DPW's forecasters had expected no substantial snow until the weekend, so there were no DPW trucks on the road when the squall hit.
"We can only be as good as our forecast," said Margie Smith-Simmons, DPW spokeswoman. "At one point it seemed to be fine."
Around 9 p.m. Thursday, DPW sent 40 salt trucks onto city streets and planned to keep them in circulation until the end of the morning rush hour.

I lost my front bumper to a bad driver myself a few months after I owned it. It sucked. I drove away, he had to be towed.

Insurance companys are VERY CHEAP. I worked for a body shop a while back and when we would be doing a small bumper job like yours, they almost always got aftermarket parts. if something was broken that wasnt on the estimate, the insurance company would send someone out to check it out and we had to prove to them that the part would have to be replaced. and sorry to say it, but progressive was one of the worst companies to work with. On that new of a car, there should be no reason that OEM parts shouldnt be used. Aftermarket is built like crap and fits like crap. Another thing they would do it tell us tomake it look original, but with crappy parts, like the saying goes, you cant make chicken salad out of chicken ____. but it sounds like you know what your are doing on the legal side of things, so more power to ya. hope it all works out for you!

Progressive lost me as a customer when they tried to charge me double the going rate for insurance on my New Kawi. I said Bye Bye and now am very happy with Geico.

BTW your bumper, OEM is Poli NOT fibreglass. If it was fibreglass it would have been shattered. Hope it comes out looking new again.

i get the box back tomorrow. Apparently they could not fix the cosmetic damage to my mr-7 17s in hyperblack and had to order me a new wheel... the new one isn't in yet, but I wanted the car back without it for the weekend. Now, how to get them to let me have the damaged wheel as a spare...

I am hoping she looks ok in the front when i get there tomorrow...
