Well, technically, they're not street legal.
I know 95% of people that have them installed probably get away with them.
I have a friend that got ticketed (fix-it ticket) but all he did was put back the original bulbs, get it signed off, then installed the HIDs again. He hasn't been ticketed since.

Seriously though, police in the NorCal bay area have been cracking down on import modded cars for a while, and that just gives them a reason to hassle you. I don't think they're as hard on tinted tails, but those 8000k HIDs are pretty darn blue (as well as not providing as much light output). I would tend to play a little safer and go with 6000k. The stock european HIDs that have the blue tint are in the 5000k range, so you'd still be more blue than them.
